1. Agreement to these terms

These Terms of Service are a binding agreement between you and Icarus Sun Protection Inc., doing business as Icarus Sunscreen ("Icarus", "we", "us" or "our"). They apply when you visit www.icarussunprotection.com (the "Website"), buy our products, or use our services.

By using the Website or placing an order, you confirm that you have read and accepted these terms and our Privacy Policy. If you do not accept them, please do not use the Website or place an order.

2. Using our website

You must be at least the age of majority in your province or territory to place an order, or have the permission of a parent or guardian. You agree to use the Website only for lawful purposes and in line with these terms.

You agree not to do any of the following.

• Give us false or misleading information, including false payment or shipping details.
• Try to gain unauthorized access to the Website, our systems or other people's information.
• Interfere with the Website, for example by introducing malicious code or overloading our servers.
• Use automated tools such as bots or scrapers to collect content or place orders.

We may suspend or refuse access to the Website, and cancel orders, if we reasonably believe these terms have been broken.

3. Orders, pricing and payment

All prices on the Website are in Canadian dollars. Applicable taxes and shipping charges are calculated at checkout based on your shipping address.

When you place an order, you are making an offer to buy. We accept it when we send you an order confirmation or ship your products. We may decline or cancel an order, for example because a product is out of stock, a price was posted in error, or we suspect fraud. If we cancel an order you have already paid for, we will refund you in full.

Payments are processed by our third-party payment processor, Stripe. We do not store your full card number. By placing an order, you confirm that you are authorized to use the payment method you provide.

Promotional codes apply only to eligible orders, cannot be exchanged for cash, and may not be combined with other offers unless we say so. We may change or withdraw a promotional code at any time, but we will not change the price of an order you have already placed.

4. Shipping and delivery

We currently ship only to addresses in Canada. We aim to ship orders within 5 business days of payment. Delivery estimates shown at checkout are estimates, not guarantees, and carrier delays are outside our control.

We may offer free or discounted shipping, promotions and other special offers from time to time. The terms of each offer, including any minimum order value, are shown on the Website or at checkout when the offer applies, and we may change or end an offer at any time. Otherwise, the shipping charge shown at checkout applies.

If your order arrives damaged, is incorrect, or does not arrive, please contact us within 30 days of the expected delivery date and we will send a replacement or refund you. Please check your shipping address carefully before you pay, because we cannot always change it once an order has shipped.

5. Returns and refunds

You may return unopened products in their original packaging within 15 days of delivery for a refund of the product price. To start a return, email us at hello@icarussunprotection.com with your order details.

Because sunscreen is a skin product, we cannot accept opened products unless they are defective, as described below. If a product arrives damaged or incorrect, we will cover the return shipping and send a replacement or refund.

A product is defective if a manufacturing or packaging fault makes it unfit for normal use or different from how we describe it. Examples include a leaking, broken or blocked pump or tube, contamination, a product past its expiry date, an unusual smell, colour or texture compared with other units from the same batch, or the wrong product. Disliking the scent or feel of a product, or having a reaction to an ingredient listed on our Website, is not a defect. If you have a reaction, please stop using the product and contact us so we can record it, even if a refund does not apply. When reporting a defect, please include photos and the date the product was purchased.

Approved refunds are issued to your original payment method within 15 business days. Unless the return is due to our error, you are responsible for the cost of return shipping. Nothing in this section limits any rights you have under consumer protection laws.

6. Product use and safety

Always read and follow the directions and warnings on the product label. The information on our Website is general in nature and is not medical advice.

No sunscreen blocks all ultraviolet rays. Sunscreen reduces but does not eliminate the risk of sunburn and skin damage, so we recommend using it together with shade, clothing, hats and sunglasses.

Our products are for external use only and should be kept out of the reach of children. Before first use, please review the ingredient list and test the product on a small area of skin. If you have allergies, sensitive skin or a medical condition, speak with a health professional before use. Stop using a product and seek medical advice if you notice irritation or a reaction.

Product photos, scents and descriptions on the Website are for illustration and may differ slightly from the product you receive.

7. Business customers

If you buy for a golf club, country club or other business, your purchase is also governed by the quote, order form or written agreement we give you (your "Business Agreement"). If it conflicts with these terms, the Business Agreement controls.

Pricing, invoicing and payment terms are set out in your Business Agreement. Late or unpaid invoices may lead us to pause deliveries until the account is settled.

If you ask us to put your logo on products or equipment, you confirm that you have the right to give us permission to use it for that purpose. By buying from us, you agree that we may display your business's name and logo on our Website and in our marketing materials to show that you are our customer, unless you tell us in writing that you do not want us to. You confirm that you have the right to give us this permission, and you can withdraw it at any time by contacting us, after which we will remove your name and logo within a reasonable time.

8. Intellectual property

The Website and everything on it, including our name, logos, text, images, product designs and packaging, belongs to us or our licensors and is protected by intellectual property laws. We give you a limited, non-exclusive right to view the Website for your personal use or to evaluate buying from us. You may not copy, reproduce, modify or use our content for commercial purposes without our written permission.

If you send us a review, photo or other feedback, you confirm that it is yours to share and does not break any law or anyone else's rights. You give us a non-exclusive, royalty-free right to use it to operate and promote our business. You can ask us to remove it at any time by contacting us.

9. Disclaimers and limitation of liability

Nothing in these terms limits any rights you have under consumer protection laws that cannot be waived, or excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence.

Subject to that, the Website and its content are provided "as is" and "as available". We do not promise that the Website will be uninterrupted or free of errors. To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses arising from your use of the Website or our products, and our total liability for any claim relating to an order is limited to the amount you paid for that order.

10. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you have a concern about an order or these terms, please contact us first so we can try to resolve it informally.

If we cannot resolve a dispute, the courts of Ontario have jurisdiction, except that if you are a consumer you keep any right the law gives you to bring a claim in the courts of your own province or territory.

11. Changes, general terms and contact us

We may update these terms from time to time. The effective date at the top shows when they were last revised. Changes apply to orders placed after the effective date, and orders you have already placed stay subject to the terms in force when you placed them.

If any part of these terms is found to be unenforceable, the rest remains in effect. These terms, together with our Privacy Policy and any Business Agreement, are the whole agreement between you and us about your use of the Website and our products.
